HEARING: Eastham District of Critical Planning Concern
Hybrid Public Hearing
CAPE COD COMMISSION
The Cape Cod Commission will hold a hybrid public hearing on Thursday, August 14, 2025 at 3:00 p.m. in person (at the Mary Pat Flynn Conference Room, 3195 Main Street, Barnstable, MA 02630) and virtually (online and by telephone) to consider, pursuant to Sections 10 and 11 of the Cape Cod Commission Act, whether amendments to the Implementing Regulations for the Eastham District of Critical Planning Concern (“DCPC”), known as the Eastham Corridor Special District (“ECSD”), are consistent with the Guidelines for the DCPC as outlined in the Assembly of Delegates designation Ordinance 17-12, dated November 1, 2017.
The Implementing Regulations were adopted on May 7, 2018 at Eastham Town Meeting and subsequently amended in 2018 and 2022. In February 2025, the Town of Eastham proposed a further amendment to the Implementing Regulations (“2025 Amendment”), which was considered by the Cape Cod Commission and certified as consistent with the Guidelines for the DCPC in a certificate dated March 19, 2025. In a memo dated June 2, 2025, the Town provided that the 2025 Amendment was further amended at Eastham Town Meeting to make the following changes to the use and dimensional tables for the Trade Park District: prohibit Mixed Use Building/Development and Multi-family Dwelling as principal uses; allow Multi-family Dwellings as an accessory use; and remove the requirement for Outdoor Amenity Spaces.
At this hearing, the Cape Cod Commission will review these changes to the 2025 Amendment for consistency with Guidelines for the DCPC.
Note: The hearing will be held in a hybrid format, both in person and virtually, with some members participating remotely, pursuant to Chapter 20 of the Acts of 2021, as amended by Chapter 2 of the Acts of 2025.
