Statement on Lowe’s appeal of DRI decision
The Executive Committee of the Cape Cod Commission approved the following statement:
The Cape Cod Commission decision denying the Lowe’s Home Center development of regional impact has been appealed to the Massachusetts Land Court. This process is one that is allowed by the Cape Cod Commission Act, which provides at section 17:
“Any party aggrieved by a commission decision on a development of regional impact may appeal the commission’s decision to the Barnstable county superior court or the land court.”
The Cape Cod Commission will defend its decision in court as one that was properly within both its discretion and authority.
