Cape Cod Commission regulations enable the agency to fulfill its duties under the Cape Cod Commission Act. Those duties include conducting regulatory reviews of projects considered "Developments of Regional Impact" or DRIs. To be approved, a project undergoing regional regulatory review may be required to address problems resulting from the development, such as making traffic improvements or providing affordable housing in a new residential development. When it is not practicable to correct a problem directly, the developer may be required to contribute a fair share of funds to solve the problem rather than undertake the actual work.
Funds collected by the Cape Cod Commission for DRI mitigation purposes are held in a special revenue account by the Barnstable County Treasurer and are tracked by project. Interest accrues on this account. The Commission then works with town officials to determine the best use of thse funds. Typically, after local officials have identified a project for which mitigation funds can be utilized, a request is submitted to the Commission and a Memorandum of Agreement is executed with the town.
